We reserve the right to amend these terms and conditions from time to time and advise you to check them carefully before making a purchase. This does not affect your consumer rights. The use of our site and any contracts formed are governed by English Law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction save that if you are a consumer, as opposed to a business, and: if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland; if you are resident of Scotland, you may also bring proceedings in Scotland.
We do not guarantee that this website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the website for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
2 Orders and Payments
Our acceptance of your order will take place when you receive from us a confirmation email which will include your order number and details about your order. At this point a contract will come into existence between you and us and we will take payment in full. If we are unable to accept your order, we will email you accordingly. We reserve the right to refuse to supply.
All prices on our website are displayed in Pounds Sterling. We accept payment via credit card and PayPal.
Prices are as stated on our website and are subject to change without notice. In the unlikely event that an item is priced incorrectly we reserve the right to supply at the correct price and will inform you prior to delivery.
Discount codes are stand alone and are not able to be used in conjunction with any other code or offer available at the time. Mia Moretti reserves the right to amend, cancel or withdraw a promotion at any time.
If we are unable to supply an item, you will be contacted by email.
Should you require an item urgently or by a specific date please phone or email us.
If upon receiving your order confirmation you realise that your order is incorrect, please contact us so that we can rectify before your order is despatched.
3 Our Products
The images of the products on the website are for illustrative purposes only. Although we have made every effort to display the colors accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
Delivery will be made to the address specified on your order under “delivery address”. The costs of delivery will be as displayed to you on the website
Upon accepting your order, we endeavour to despatch your goods within 24-48 hours depending on stock availability but time of delivery shall not be of the essence of the contract between us. Please note that during busy periods (such as during sales) it may take longer to despatch items to you.
Should you require an item urgently or by a specific date please phone or email us.
We do not accept liability for any out of pocket expenses or other costs incurred due to delayed delivery. Our liability for any goods lost in transit is limited to the sum paid by you for the goods.
You agree that proof of delivery supplied by our delivery company is sufficient evidence to establish that goods have been received. We require a signed proof of delivery for all deliveries. A product shall become your responsibility from the time of delivery.
5 Returns & Exchanges
Your rights to return goods are protected under the Consumer Contracts (Information, Cancellation and Additional Changes) Regulations 2013.
Any items which a customer has requested to be altered or tailor made are then rendered to be non-returnable. Otherwise, if you are not 100% happy with your purchase you can return it to us within 14 days of receipt by you. Unwanted items must be in the original condition in which you received them with all original tags and packaging. Upon us receiving your items a refund will be issued within 14 days of receipt providing that the items are in their original brand new, unused and resalable condition.
When trying on items please ensure that you are not wearing make up, deodorant or any other items which may leave residue on the garment or interfere with it. We are unable to accept the return of any item which has evidence of wear, excessive handling, or that these instructions have not been followed.
If your items do not reach you in good condition, you must notify us within three days of receipt.
If you believe that the item, you have received is faulty you must notify us within 14 days of receipt of your item.
When returning items please ensure the “Returns & Exchanges” paperwork included in your delivery is completed, stating the reason for return and if you require an exchange or refund. Please also include a copy of the invoice which accompanied your order.
For your own protection we recommend using a signed for delivery service or one which insures you for the value of the goods you are returning. We do not cover postage costs for returning items. The original postage paid to receive your order will be refunded providing the complete order is returned.
International customers should note that we do not refund postage costs and that any request for an exchange will incur an additional delivery charge to send your exchanged item.
We aim to process all returns, exchanges, and refunds within 14 days of receiving them into our warehouse. Please be aware that once your refund has been processed by us it can take 3-5 days to appear in your account. This is beyond our control and is dependent on your payment provider.
Refunds are issued against the original method of payment. We do not issue refunds to third parties.
6 Intellectual Property
All designs, images and text on these pages are the sole property of PLM Partners Limited and may not be reproduced.
7 Data Protection
We will use the personal information you provide to us: to supply the products to you; to process your payment for the products; and if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.
We are unable to provide information about an order to a third party.
8 Our responsibility for Loss or Damage Suffered by you
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products including the right to receive products which are: as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; fit for any particular purpose made known to us; supplied with reasonable skill and care; and for defective products under the Consumer Protection Act 1987.
Please note that we only provide the website for domestic and private use. You agree not to use the website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We do not guarantee that the website will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform to access the website. You should use your own virus protection software.
You must not misuse the website by knowingly introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful.
